Recommendations on Chakma-Hajong refugee issue kept unheeded

Tom Simai

The Confidential Report on Chakma-Hajong Refugee (CHR) problem of Arunachal Pradesh 2007 submitted to the Chief Minister in 2007 reveals how the State Government  has locked such sensitive issue in a cold storage even after the 10 points recommendation put forth by the core committee on its 15 page report on CHR problems.

The 10 points recommendation was propounded 4 years ago, before the M’Pen Riots, before the encroachment of reserve forest and community land by the CHR in such colossal scale.

By going through the recommendation we will find that the laxity and irresponsible act by the state Govt has led the CHR issue to such enigmatic proportion.  If the state Govt had only acted to the recommendation then perhaps the CHR issue would had amicable conclusion by now.

The following are the 10 points recommendation made by cabinet committee on the 15 pages report that was headed by Finance Minister Setong Sena, the then Speaker of Arunachal Pradesh Legislative Assembly along with Nabam Tuki, Kipa Babu, Ngurang Pinch, Kamlung Mossang, Chowna Mein, Karikho Kri, Chow Tewa Mein,  Chow Pinthika Namchoom, C C Singpho, Phosum Khimhoon, and Wangnia Pongte as its core members.

1. It transpires from the interaction/proceeding that there no apparent objection on granting of Indian Citizenship to CHR in conformity with the Rules/Acts and Constitutional provisions by the Govt. of India (GoI), but no land possession/settlement right be given to these refugees in the state of Arunachal Pradesh without previous approval of the State Government in terms of Bengal Eastern Frontier Regulation Act, (BEFRA) 1873.

2. To revive the Core Committee of CHR imbroglio headed by  Chief Minister of Arunachal Pradesh  the committee also suggests that the State Government pursue the GoI for constitution of tripartite committee consisting of Govt. of Arunachal Pradesh, representatives of CH and GoI to be headed by a Central Minister of Ministry of Home Affairs, GoI to discuss and decide all this vexed CHR issue and find out an acceptable solution.

3. The committee also suggests issue of inner line permit to CHR in accordance with the BEFRA 1873.

4. The committee also suggests for creation of a separate department to deal with the refugees and interstate boundary issues.

5.The committee is also of the view that the state should conduct a special survey on CH inhabited areas to find out the exact number of CHR inhabitants as on date and also settled during 1964 to 1969 and illegal migrants thereafter. While conducting special survey, the state machinery be asked to prepare dossiers of each CH family, their originally allotment and present occupied area and present status of those land and pending court cases if any.

6.In order to protect the political interest of the indigenous people of Arunachal Pradesh it is suggested that steps may be taken so that lone general assembly constituency is not earmarked in the CH inhabited area

7. Steps may be taken to evict the unauthorized CHR from the various reserve forest areas in accordance with the provisions of various forest acts and laws and also to pursue Court for vacation of interim relief given to CH in the form of stay.

8. As demanded by the AAPSU, all criminal cases pending against the former/present students in connection with the agitation against the CHR should be withdrawn/closed by the government.

9.The committee is of the opinion that an acceptable solution has to be tuned rather than keeping this vexed problem pending for decades. Therefore, the committee is of the opinion that these CHR be confined to original settlement areas and be placed under administrative control of an ADC. And following further course of action to be initiated are recommended herewith

• The original settlement areas be demarcated on ground by erecting CC pillars fencing and also be notified through Arunachal Pradesh Gazette to avoid any future legal complicacy.

• The original settlement areas could be leased out for certain period and can be renewed subject to their satisfactory performance in maintenance of peace and other etc. but no permanent possession right on the land be given to CHR. While doing so, the practice being followed in case of Pvt/PSU like plywood factories, industries, NEEPCO, NHPC, OIL/Coal/SEZ sectors etc, could be followed.

• The GoI to provide special financial package for creation of infrastructures including rehabilitation grant and clear assurance for continued budgetary allocation for maintenance to meet up recurring expenditure for settlement area.

• Even if they (CH) are declared as Indian citizens by GOI these refuges shall have to remain as non-APST and under any circumstance, no repeat, no APST status be given for any purpose.

• These CH shall have no right to purchase/possess any immovable property outside notified settlement area in terms of section 7 of BEFRA, 1873.

• Inconformity with BEFRA, 1873, the Chin Hills Regulations, 1896, shall automatically govern these CH people. (The writer can be reached at simaitom@gmail.com)

North East Regional Commonwealth Parliamentary Conference

Evolve a common strategy to enhance regional tourism: Governor

ITANAGAR, Apr 29: Arunachal Pradesh Governor Gen JJ Singh urged upon the members of North East Regional Commonwealth Parliamentary Association (NERCPA) to evolve a common strategy to enhance regional tourism through tourist packages involving different states of the North East region. It should be evolved in such a way that people of the region derive socio-economic benefit out of it. Governor Gen Singh said this while addressing the closing function of the 13th annual conference of the NERCPA here today.

NERCPA been successful in getting several Restricted Area Permit procedures exempted to harness the potential of its unique cultural heritage, its pristine environment and to develop tourism in the region, the Governor observed. Singh, however, quoting First Prime Minister of India Pundit Jawaharlal Nehru’s remarks, said “we have to ensure that development is not forced on the people. It should be at a pace which they can absorb.”  Our citizens should be active partners in the growth process, Gen Singh said to the members of Parliaments and State legislators of the region.

Stating that the most important task of a legislature in a democratic regime is to give legitimacy to the government by providing representation to the citizenry, Governor said, the Legislatures are the strongest pillar of the Indian democracy and we all want this institution to be further strengthened. Legislatures represent a permanent and independent link between the populace and the government. As people’s representative, whatever decision you take should be with an ultimate aim of ensuring that the fruits of development reach the poorest and the most down-trodden sections of the society, he added.  No development in any form is possible without full support and ownership of initiatives by the respective Members of Legislative Assemblies. However, once we have that, development will be sustainable and we will be able to meet the objectives we set for ourselves. For that we have to ensure equality amongst the stakeholders and also ensure their right to influence and right to control. It will help in pin-pointing responsibility, increase motivation and enhance team work and productivity and instill strong commitment in all, Governor said.

Governor hoped that NERCPA, as it has been in the past, will continue to promote knowledge on constitutional law amongst the people of the region and also further strengthen the time-honoured traditions of parliamentary democracy.

Touching on the achievements of the association, Governor pointed that it is due to the initiative of NERCPA that the Guwahati Airport has become a full-fledged International Airport and named as Gopinath Bordoloi International Airport, after one of the most revered leaders of the Northeast region. The Association’s stress on improvement and opening of trade routes including Pangsau Pass in Arunachal Pradesh will have a direct and positive impact for the North-Eastern region by fully exploiting the potential of the Look East Policy, he said. Opening of connectivity routes like the historic Stillwell road, which I have been strongly advocating, will provide huge opportunities for boosting trade and commerce activities in the whole northeast region. As timber would be the main item of import from Myanmar, this would also help revive many of our wood-based industries, especially of Assam, Nagaland and Arunachal Pradesh  which had to be shut down following the Apex Court’s restrictions on timber operations in 1996. Governor also mentioned that increase in flow of central funds to the whole North-Eastern region and establishment of a unique institution called North East Regional Institute of Parliamentary Studies, Training and Research in Dispur in Assam are some of the other important achievements of the association.

Underscoring the importance of financial autonomy of the Legislative Assembly Secretariat, Governor said, financial autonomy of the Legislative Assembly Secretariat is absolutely mandatory. It will help the State Legislatures to achieve confidence, ability, freedom and supremacy to run a Legislature in accordance with constitutional provisions. But, he added, we should try and evolve a national consensus on the issue before a final decision is taken, otherwise there can be confusion.

On NERCPA members’ proposal to hold a Regional Seminar on Legislature Audit Interface, Governor pointed that such seminars will definitely help in ensuring speedy disposal of audit paras and suggest ways and means to do it within a fixed time frame.

Earlier, in his welcome address, Chairman of NERCPA Charles Pyngrope, Meghalaya Legislative Assembly Speaker congratulated the delegates and participants for their thought proving discussion and debate. The conference has delved into the relationships between the Legislature and the Constitutional Audit, he informed.

Expressing gratefulness to Lok Sabha Speaker Meira Kumar, Pyngrope said, her presence has enhanced the prestige and importance of the conference.

Deputy Speaker of Arunachal Pradesh Legislative Assembly Tapang Taloh also spoke on the occasion.

NERCPA Vice Chairman, Wanglin Lowangdong, Speaker, Arunachal Pradesh Legislative Assembly, NERCPA Secretary Gauranga Prasad Das, Principal Secretary, Assam Legislative Assembly, Speakers of Assam, Mizoram, Nagaland & Sikkim,  Deputy Speakers of Meghalaya, Mizoram, Sikkim & Arunachal Pradesh, Parliamentary Secretaries, MPs, MLAs and Secretaries of Nagaland, Meghalaya, Mizoram, Sikkim & Arunachal Pradesh along with other guests and invitees were present on the occasion. What did they do with our money?

Dear Editor,

On dated 18th April 2011, we on behalf of Kargu Kardi Student’s Union (KKSU) had alleged the Water Resource Department, Basar Division of mismanagement of fund allocated in the financial year 2010-11. We had stated that an amount of Rupees 64.00 lakhs(approx) was allocated in the Tirbin, Yomcha and Kamba section under the WRD Sub Division Aalo, out of which only an amount of Rupees 30.00 lakhs (approx) has been used to pay the outstanding bills of the MIP/MIC contactors. It was distributed in such a way that it was insufficient even to meet the half  the amount of the bill of a contractor and we also appealed the concern department to reflect the use of such huge amount of fund in the white paper rather than to keep the common people in confusion.

The mentioned department has out rightly violated the AOP provision in 2010-11 fiscal years by not making payment to the contractors accordingly. In spite of our demand, the department has failed to show any kind of explanation so far.

We once again appeal the RWD Basar division for the white paper reflection and let the public know how the fund allocated was used without clearing the outstanding bills of two to three years or more.

In addition to that, we would like to appeal for the early completion of all the PMGSY Schemes going on in our jurisdiction. So far most of the works are going in a very slow face and the half constructed roads are adding the trouble for the public of the concerned area. It has been learnt that the concerned department are extending the duration of the work/project completion for reasons unknown to us. We appeal the department not to further, extend the duration for the completion of the project and let the work be completed on time and the defaulters should be dealt with accordingly.

Yours,

Bomli Yomgam

Towards safe driving

Dear Editor,

A passenger Bus, from Itanagar to Guwahati Bearing Regn. No.ARO4-2460 met with an accident on 27/4/2011 at around 12pm to 1 am, about 30 kms away from Tezpur towards Guwahati. But I do not see it reported in any local newspapers. About 6 people were injured serious enough to be taken to the hospital by an ambulance which arrived swiftly after about 25 minutes. Most of the passengers sustained minor injuries, and I thank God that no one died in the incident.

It is immaterial whether it is reported in the newspaper or not. But the incident provoked a serious thought in my mind about “safety”.

Many of us have a perception almost akin to superstition that; accidents are inevitable. It is perceived as something pre-destined to happen where someone should die. It is scary. We don’t care to ponder much as to why and how such accidents happens, specially those involving many helpless passengers. After such incidents it is irritating as well to question or be questioned why and how things happened; when one is shocked and bearing the brunt of the outcome, which can be devastating. But the knowledge definitely helps us in averting such accidents in the future.

Luxurious seat, video entertainments, air condition system and double suspension comforts etc which are common these days are business hoodwinks to make us pay more, they never make the traveling safe in any way.

In order to make mass commuting safer I seek to earnestly suggest the following points which I believe is pragmatic, if we the consumers insist and if the appropriate authority step in and address them.

Credentials of Drivers to be compulsorily posted, at least in the ticket counters of every passenger ferrying parties, clarifying his experience in driving, fitness to drive and specially about alcoholic habits which is very common among driver, and a cause for many ghastly accidents.

Lives of passengers to be insured and accidents to be covered by appropriate insurance policy.

Specific speed limit and appropriate stoppage to be designated as per requirement of the journey.

No heavy luggage like brief cases and other lethal tools or substance, when accident occurs be allowed inside the sitting area.

Mechanical fitness certification for every trip.

These few points came into my mind, when I evaluate the incident as a passenger of that fateful Bus. We can not leave our lives in the hands of careless drivers, mechanical deficiencies and the system the transporters go by. It is us only who can ensure our safety. Let us always be discerning consumers and guarantee safe traveling. These points and the like can be enforced by the APSTC, Town municipality, Transport Associations or by any Consumers forum for the general be hoof. Let us do it.

Yours,

Concern Citizen

Help us to fight against fire mishap

Dear Editor,

I on behalf of Dumporijo Town residents would like to draw a few lines in your daily esteem regarding fire service. The people of Dumporijo are crying for better fire service station. Because the present fire station situated in main Daporijo town is 16 KM from away. When fire incident takes place at Dumporijo the fire service team cannot reach in right time and by the time they reach the whole thing gets burnt down. So Dumporijo need establishment of fire service station at the town to fight any fire disaster in better way.

Therefore, I would like to appeal to the Pnachayat leaders, MLA of Dumporijo and state government for kind cooperation for immediate establishment of Fire station at Dumporijo town for safety of poor people.

Yours,

Doli Nguki,

Itanagar
